Chapter 7 Bankruptcy
Chapter 7 is the most common chapter that consumers file. It is known as a liquidation bankruptcy as the bankruptcy trustee can sell your non-exempt property to repay your creditors. Chapter 13 is less common than chapter 7 but is a great tool and offers benefits that chapter 7 does not offer. Chapter 13 offers you the ability to get caught up on secured debt payments, like a mortgage or auto loan. Chapter 13 can also discharge property settlement debt where chapter 7 cannot. Chapter 13 is a great option for those who are above the median income, have non-exempt property they want to keep, or are behind on mortgage payments.
Student Loan Discharge
Student loan debt is one of the biggest issues we face. Many people believe that student loans cannot be discharged. This simply is not true. Student loans have been able to be discharged for year, but there was a difficult standard to meet to get the student loans discharged. As of November 2022, the United States Department of Justice released new guidelines on when they will stipulate to a student loan discharge. While you still need to meet the standard for discharge eligibility, it is now easier than ever to discharge student loans. This bonus course educates you on how you can potentially get your credit score as high as 720 in as little as two years after filing.
Another frequent questions or concerns from our clients revolves around their vehicles. Many clients are worried about being able to keep their current vehicle. Usually they can keep it, but there may be additional help that Conley Law can provide in this area. Our bankruptcy attorney will review your auto loan situation to see if there is a better option for you.
One of these options is to redeem your vehicle in your chapter 7. If your vehicle is worth significantly less than you still owe, redemption might be an option for you. This involves taking out a new loan to pay off your existing loan at the market value of your vehicle. Our Ohio bankruptcy attorney works with 722 Redemption to get our clients approved for the redemption loan.
While redemption is not an option in chapter 13, we can look at cramming the loan down to the value of the vehicle. With this option, we can potentially lower the payments on the vehicle and have it be paid through the chapter 13 plan.
Another option for our clients is to replace their vehicle. Maybe your vehicle is not worth keeping, either because it is old or has issues. A replacement is a great solution for you.
